  1. Introduction

Welcome to Blue Phoenix Rising (“we”, “us”, “our”). By accessing or using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

  1. Services

Blue Phoenix Rising offers various healing energy services, including but not limited to Soul Contracts, Readings, Emotion Code and Body Code, QHHT, Reiki, Medical Reiki, Animal Healing & Communication, and Tarot reading (‘Services’). These Services are provided to support physical, emotional, and spiritual well-being.

  1. Eligibility

You must be at least 18 years old to use our Services or have consent from a parent or guardian if under 18 years old. By booking an appointment, you confirm that you meet this requirement.

  1. Booking and Cancellations
  • Appointments: Appointments can be booked through our website, by phone, or in person.
  • Cancellations: We require at least 24 hours’ notice for cancellations or rescheduling. Cancellations made within this period may be subject to a cancellation fee.
  1. Payment
  • Fees: Service fees are listed on our website and are subject to change without notice.
  • Payment Methods: We accept Bank transfers, cash, or debit card payments.
  • Charges: Time for payment is of the essence. If the customer fails to make a payment due to us for the Services by the notified due date, we reserve the right to charge additional interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgment. Interest will accrue each day at 4% a year above the Bank of England’s base rate.
  • Refunds: Refunds are not provided for completed Services. In case of dissatisfaction, please contact us to discuss your concerns.
  1. Confidentiality

We respect your privacy and are committed to protecting your personal information. Any information shared during sessions will be kept confidential and will not be disclosed to third parties without your consent, unless as required by law.

  1. Health and Safety
  • Medical Conditions: Please inform us of any medical conditions, allergies, or injuries prior to your session. Our Services are not intended as a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of your GP or other qualified health professionals with any questions you may have regarding a medical condition.
  • Sanitation: We maintain high standards of hygiene and sanitation. Clients are requested to follow our safety guidelines during visits.
  1. Liability
  • No Guarantees: While we strive to provide high-quality services, results may vary from person to person. We do not guarantee specific outcomes.
  • Limitation of Liability: To the extent permitted by law, Blue Phoenix Rising excludes liability arising out of or in connection to any direct, indirect, incidental, special, consequential, punitive damages, or any loss of profits, revenue, data, goodwill or business opportunities whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable arising from the use of our Services. In the event that any liability arises notwithstanding the exclusions above, our total aggregate liability to the customer shall in no event exceed the total amount paid by the customer to us for the Services 12 months preceding the event giving rise to the liability.
  1. Code of Conduct

Clients are expected to behave respectfully towards our staff and other clients. We reserve the right to refuse our Service at any time to anyone exhibiting inappropriate behaviour.

  1. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on our website and continued use of our Services indicates acceptance of the new terms.

  1. General

Intellectual Property: means patents, rights to inventions, copyright and related rights, moral rights, trademarks and service marks, business names and domain names, rights in get-up, goodwill and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets), and all other intellectual property rights, in each case whether registered or unregistered. All Intellectual Property Rights in or arising out of or in connection with our Services (other than Intellectual Property Rights in any materials provided by the customer) shall be owned by us.

Third party rights: Unless we expressly agree otherwise, the provision of our Services does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of this Terms of Service.

Severance: If any provision or part-provision of this Terms of Service is or becomes invalid, illegal, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement.

Force majeure: We shall not be in breach nor liable for delay in performing, or failure to perform, any of our obligations if such delay or failure result from events, circumstances or causes beyond our reasonable control.

Governing law & jurisdiction – The Services provided in accordance with this Terms of Service are governed by the law England and Wales and each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with our Services or its subject matter or formation.
